Terms & Conditions

These terms govern your use of PropDesk. We have tried to write them so that they can actually be read.

Who these terms are between

These Terms and Conditions form the agreement between you and Tomás Reis dos Santos, sole trader (Empresário em Nome Individual) registered in Portugal under NIF 256491968, with registered address at Avenida do Escurinho, Lote 39, 6.º R, 7000-372 Évora, Portugal (“PropDesk”, “we”, “us”), for your use of the getpropdesk.io website and the tools it provides.

By using the service, creating an account, or subscribing to a paid plan, you accept these terms. If you do not accept them, please do not use the service.

Three further documents form part of this agreement and should be read with it: our Disclaimer, which sets out the limits of what the tools promise; our Privacy Policy; and our Affiliate Disclosure.

The service

PropDesk is a physics-based toolkit for people who design and build drones. It includes a build calculator, a searchable component database, tools that suggest or complete a build from goals or from partial choices, a cost optimiser, and a community area where builders can document and publish projects.

The tools produce estimates derived from a mathematical model and from component data compiled from manufacturer datasheets and published sources. They are decision support. They are not engineering certification, airworthiness approval, or professional advice, and their output must be verified independently before you rely on it. The Disclaimer explains this in full and is part of these terms.

We may change, add, or withdraw features as the product develops. Where a change materially reduces what a paid plan provides, we will give you reasonable notice and you may cancel before it takes effect.

Accounts and eligibility

Some features work without an account. Others (saving builds, publishing projects, commenting, and paid plans) require you to register.

You must be at least 16 years old to create an account. If you are under 18, you may only subscribe to a paid plan with the agreement of a parent or guardian, who accepts these terms on your behalf.

You agree to give accurate registration information, to keep your sign-in credentials secure, and to accept responsibility for activity carried out through your account. We sign you in using a one-time code sent to your email address, so control of that mailbox is control of the account. Tell us at support@getpropdesk.io as soon as you suspect unauthorised use.

One person, one account. You may not share an account, sell it, or transfer it to someone else.

Plans, prices and billing

PropDesk offers one free plan and two paid subscriptions:

All prices are the total payable, including any VAT that applies (see “Tax” below). Annual plans are charged once for twelve months and work out cheaper than paying monthly; you choose the billing period at checkout, and the price for the period you selected is shown before you pay.

What you are buying is what is listed above and on the pricing page at the moment you subscribe. We also publish a roadmap describing features we intend to build. Roadmap items are statements of intention, not promises, and are not part of this contract. They may change, be delayed, or be dropped. Please never subscribe because of a feature that does not yet exist. If a roadmap feature is released and falls within your plan, you receive it at no extra cost.

Billing

Paid plans are billed through our payment provider, Stripe. Card details are entered directly with Stripe and we never receive or store your card number.

Subscriptions renew automatically for successive periods equal to the billing period you chose at checkout, until you cancel. If a payment fails, we may suspend access to paid features until it is resolved; your account and your saved work are not deleted for this reason.

Tax

If you are a consumer, the price shown at checkout is the total you pay: it already includes any VAT that is due. The plan prices above are quoted on the same basis, so there is never an unexpected amount added at the end.

Where we are covered by the Portuguese small-business VAT exemption (Article 53 of the VAT Code), no VAT is added and the amount you pay is the amount shown. If VAT later becomes chargeable on your purchase (for example under the EU rules for digital services supplied to consumers in other Member States) the checkout total will state the tax included, and we will give you notice before any resulting change to your price takes effect.

If you are buying as a business and provide a valid EU VAT number, your purchase may be invoiced without VAT under the reverse-charge rules, in which case you account for the VAT in your own country.

Price changes

We may change prices. We will give you reasonable notice before a change applies to you, and a change never affects a period you have already paid for. If you do not accept a new price, you may cancel before it takes effect.

Right of withdrawal (consumers in the EU)

If you are a consumer in the European Union, you normally have 14 days to withdraw from a distance contract without giving a reason.

PropDesk is a digital service that becomes available immediately. Before you are sent to the payment page, we therefore ask you to do two things expressly: to request that we begin providing the service straight away, and to acknowledge that you lose the right of withdrawal once the service has been fully performed. We record that you gave this consent, and the moment you gave it.

If you give that consent and then withdraw before the period is fully performed, any amount due back to you is calculated in proportion to what has already been provided, as the law requires. On an annual plan the proportion is calculated against the full twelve-month period, so withdrawing early in the year returns most of what you paid. If you do not give that consent, the service starts after the 14-day period ends.

To withdraw, simply tell us at support@getpropdesk.io. A clear statement is enough; no particular form is required.

Cancellation and refunds

You may cancel a subscription at any time, from your account settings or by emailing us. Cancellation takes effect at the end of the billing period you have already paid for, and you keep full access until then. On an annual plan, that means until the end of the twelve months you paid for. Nothing is deleted when a subscription ends: your account reverts to the free plan and your saved work remains, subject to the limits of that plan.

Beyond the withdrawal rules above, we do not refund periods that have already begun, except where mandatory consumer law requires it or where we have failed to provide the service. If something has gone wrong, write to us, because we would rather fix it than argue about it.

Your content and the licence you give us

You keep ownership of everything you create on PropDesk: your builds, projects, build diaries, comments, and photographs (“your content”).

So that we can operate the service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical purposes such as resizing, and display your content within PropDesk, for as long as you choose to keep it published. If you publish a project publicly, that licence also covers showing it in the public areas of the service and in ordinary promotion of PropDesk itself, for example a screenshot of the community page.

The licence ends when you delete the content or your account, except for copies we must keep by law and copies that persist temporarily in routine backups.

You confirm that you hold the rights to what you publish and that it infringes nobody else's rights. In particular, you must not upload photographs of identifiable people without their consent, and you are responsible for respecting the privacy and image rights of others.

Content rules, reporting and moderation

You must not publish content that is unlawful, infringing, hateful, harassing, deceptive, or that endangers safety. You must not use the community to advertise unrelated products or to distribute spam.

Reporting content

If you believe content on PropDesk is illegal or breaks these rules, you can report it using the report control shown next to projects, entries, and comments, or by emailing support@getpropdesk.io. That address is also our single point of contact for authorities and for users on content and legal notices.

We review every report and act where it is appropriate. We may remove content, restrict its visibility, or suspend an account.

If we act against your content

Where we remove or restrict your content or your account, we will tell you and give you a statement of the reasons, including the ground we relied on and how you can contest the decision, unless the law prevents us from doing so.

If you disagree with a decision, write to us at the address above and we will reconsider it. You may also take the matter to an out-of-court dispute settlement body certified under Article 21 of the Digital Services Act, and nothing here prevents you from going to court.

Acceptable use

You agree not to:

  • disrupt, overload, or interfere with the service or its infrastructure;
  • access the service by unauthorised means, or attempt to defeat access controls, plan limits, or usage quotas;
  • scrape, harvest, or extract the component database or other content in bulk, by any automated means;
  • reverse-engineer or attempt to reconstruct the underlying models, except to the extent the law expressly permits;
  • resell, sublicense, or redistribute the service or its output as a competing product;
  • use PropDesk to break the law, or to design anything intended to cause harm.

The component database and the way it is selected, verified, and arranged represent substantial investment on our part and are protected accordingly, including by database rights.

Affiliate links

Some links from PropDesk to third-party shops are affiliate links, and we may earn a commission if you buy through them. The price you pay is the same either way.

Commission never influences what the tools recommend or how components are ranked. Our Affiliate Disclosure explains this in full.

Third-party shops are independent of us. We are not a party to anything you buy from them, and their own terms, prices, availability, delivery, and warranties apply to that purchase.

Intellectual property

The PropDesk name and logo, the website, its design, code, text, the physics models, and the structure and compilation of the component database belong to us or to our licensors, and are protected by intellectual-property law.

Manufacturer names, product names, and technical data referenced in the database belong to their respective owners and are used to identify components. Their appearance in PropDesk does not imply any partnership with, or endorsement by, those manufacturers.

We grant you a limited, personal, non-transferable right to use the service under these terms. You may freely use the results the tools produce for your own builds, including commercially. No other rights are granted.

Disclaimers and limitation of liability

The service is provided “as is” and “as available”. Our Disclaimer sets out in detail what the tools do and do not promise, and forms part of these terms.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, for loss of profit, data, or opportunity, or for damage to a drone, its components, or third-party property arising from a build you designed, assembled, or flew using output from PropDesk.

Where we are found liable, and to the extent the law allows liability to be limited, our total liability towards you for all claims arising in any twelve-month period is limited to the total amount you paid us for the service in that period.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law. That includes liability for death or personal injury caused by our negligence, for fraud, and for any liability arising from wilful misconduct or gross negligence. If you are a consumer, your mandatory statutory rights are unaffected by anything written here.

Suspension and termination

You may stop using PropDesk at any time and delete your account from the account panel. Deleting the account cancels any active subscription immediately and removes your data, as described in the Privacy Policy.

We may suspend or end your access if you seriously or repeatedly break these terms or the law, or if we are required to for legal or security reasons. Except where an immediate response is necessary, we will warn you first and give you a chance to put things right. Where we act, we will explain why, as set out in section 8.

If we end your access other than for a breach by you (for example because we discontinue the service) we will refund the unused portion of any period you have paid for.

Governing law, complaints and disputes

These terms are governed by Portuguese law. If you are a consumer, you also keep the protection of any mandatory rules of the country where you live, and this choice of law does not take those away.

Consumers may submit a complaint through the Portuguese electronic complaints book at www.livroreclamacoes.pt.

Alternative dispute resolution

For consumer disputes that we cannot resolve directly, the competent alternative dispute resolution entity is:

CNIACC has residual national competence for consumer disputes in areas not covered by another competent entity. We inform you of this entity as the law requires; we have not signed a full adhesion agreement with it, so participation in a procedure is decided case by case. A full list of Portuguese entities is available at www.consumidor.gov.pt.

Nothing above prevents you from bringing a claim before the courts that the law makes available to you.

Changes to these terms

We may update these terms as the service develops or as the law changes. The version number and effective date at the top of this page always show the current version.

If a change materially affects your rights or obligations, we will give you reasonable notice by email or in the app before it takes effect. Continuing to use the service after that means you accept the updated terms. If you do not accept them, you may cancel and stop using the service, and we will refund the unused portion of a period you have paid for.
